Walk Massachusetts Challenge

By entering, you understand that you are providing your information to Sponsor (defined below). The information you provide will be used to send marketing communications related to the Sponsor. Information collected in this Challenge will be used in accordance with the Sponsor’s privacy policy, which may be viewed at https://mcoaonline.com/privacy-policy/.

By participating in the Challenge, Participants hereby agree to the collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policies. Notwithstanding the foregoing, all Participants acknowledge that if they are chosen as a Winner, certain of their personally identifying information may be disclosed to third parties, including, without limitation, on a winner’s list. All personal information submitted as part of the Challenge may be shared by and between the Released Parties and their affiliates and partners, and such affiliates and partners will use disclosed personally identifying information in accordance with their respective online privacy policies.

The Challenge may be held, hosted, or promoted on social media platforms including but not limited to Twitter, LinkedIn, Facebook, and any of its affiliated sites (The “Media Platforms”). By participating in the Challenge, you hereby agree to adhere to the Terms of Use, Privacy Policy and any other terms governing access to the Media Platforms, their servers, or their content. Challenge is not sponsored or endorsed by the Media Platforms. Except where prohibited by law, entry and acceptance of Prize constitute permission to use winner’s name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

  • CHALLENGE DESCRIPTION:

The Walk Massachusetts Challenge Challenge (the “Challenge”) entry period begins Monday, May 1, 2023 at 12:00:01 a.m. Eastern Time (“ET“) and ends Tuesday, October 31, 2023 at 11:59:59 p.m. PT (the “Challenge Period”). The Challenge will consist of one (1) drawing to award eighty-five (85) prizes (each a “Prize“). Entry in the Challenge does not constitute entry into any other promotion, contest or Challenge. By participating in the Challenge, each Participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Massachusetts Association of Councils on Aging and Senior Center Directors, 116 Pleasant Street, Room #306, Easthampton, MA 01027 ( “Sponsor”), whose decisions shall be final and legally binding in all respects.

  • ELIGIBILITY:

    The Challenge is open to legal residents of the Commonwealth of Massachusetts, who are at least eighteen (18) years of age at the time of entry (the “Participant”). Employees, officers, and directors of Sponsor, their Advertising and Challenge agencies (collectively, the “Challenge Entities”), and each of their immediate family members and/or people living in the same household are not eligible to win a Prize. All eligibility is subject to all federal, state and local laws and regulations. All entries submitted are the property of the Sponsor. The Sponsor’s database clock will be the timekeeper for the Challenge.

  • HOW TO ENTER:

    You may enter this Challenge on the Sponsor’s Challenge page . All entries must be made online at www.walkmachallenge.com during the Challenge Period. Complete all required fields on the registration form which may include: your full name, street address, city, Zip code, age, phone number, valid Email address and selecting one of the six (6) challenges to participate in. Complete the entry by agreeing to the Official Rules and submit.

To qualify for a Prize, Participant must register, track their challenge activity and complete the challenge select upon registering.

You will earn one (1) entry for each milestone you achieve and log on your account. Maximum number of entries per person is four (4).

The Commonwealth Challenge

Walk, Jog or Run 88 Days (at least 30 minutes per day) to celebrate the year Massachusetts became the sixth state!

The Turnpike Challenge

Walk, Jog or Run 126.6 Miles (or about 253,000 steps) to celebrate the length of the Massachusetts Turnpike from Boston to Lee!

The Shoreline Challenge

Walk, Jog or Run 192 Miles (or about 384,000 steps) to celebrate the length of the Massachusetts shoreline!

The Reservoir Challenge

Walk, Jog or Run 412 Miles (or about 824,000 steps) to celebrate the number of gallons of water in the Quabbin Reservoir!

The Capital Challenge

Walk, Jog or Run 655 Miles (or about 1,310,000 steps) to celebrate approximately 655,000 people living in Boston!

The Slam Dunk Challenge

Walk, Jog or Run 891 Miles (or about 1,782,000 steps) to celebrate the first basketball game held in Springfield in 1891!

Once you select and submit your challenge, it may not be changed.

Choose based on your current walking abilities or challenge yourself to reach a higher goal. Be your own guide as to what you can do! You can walk inside, outside, on a track, on a treadmill, at a park, at a mall, with family, with friends, with your dog or alone! Track your walking (we recommend daily or weekly) between May 1 st and October 31st. Once you complete a Milestone in your selected challenge, you’re entered for a chance to win.

*Councils on Aging will receive an entry for each person who completes their challenge. Sixteen (16) COAs will win in all, and one lucky COA will win $1,000 for future programming! For example, if Framingham has 50 registered Participants and 30 of them complete the challenge, Framingham receives 30 entries into the COA Challenge.

Limit: Maximum of four (4) entries per person. Limit: One (1) Prize per person. Entries in excess of any stated limitation, and entries generated by script, macro or other automated means, or any means that subverts the entry process, will be void. Any attempted form of entry other than as described herein including the use of multiple Email addresses by the same person, is void. Sponsor will determine, in its sole discretion, what constitutes a valid entry, and reserves the right to reject any submissions that it deems, in its sole discretion, to violate any of Sponsor’s policies, standards, or practices. All materials and entries submitted become the property of the Sponsor and will not be returned or acknowledged.

WARNING: ANY PARTICIPANT THAT UTILIZES OR CREATES MULTIPLE EMAIL ACCOUNTS OR EMAIL ADDRESSES OR MULTIPLE EMAILS FROM ONE IP ADDRESS TO BOOST THEIR NUMBER OF ENTRIES WILL BE DISQUALIFIED EVEN IF AN ANNOUNCEMENT OF THE ENTRY WINNING HAS BEEN PUBLISHED. Automated methods of entry and entry by proxy are also prohibited.

In case of a dispute over the identity of an Participant, the authorized account holder of the Email address used to enter will be deemed to be the Participant. “Authorized account holder”is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted Email address.

Sponsor reserves the right to cancel or modify the Challenge if fraud or technical failures destroy the integrity of the Challenge as determined by the Sponsor, in its sole discretion, and to award the Prizes based on eligible entries received prior to the cancellation.

Sponsor is not responsible for problems downloading or uploading of any Challenge-related information to or from the web site or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Participant’s ability to participate in the Challenge.

  • RANDOM DRAWING DATE / WINNER NOTIFICATION:

A random drawing will be conducted by the Sponsor on or about Thursday, November 30, 2023 from all eligible entries received during the Challenge Period.

Winner Notification: Potential winner will be contacted via email by their local Council on Aging. Sponsor shall have no liability for any potential prize winner notification that is lost, intercepted or not received by any potential prize winner for any reason. If, despite reasonable efforts, any potential prize winner does not respond within three (3) calendar days of the first notification attempt, or if the prize notification or Prize is returned as unclaimed or undeliverable to such potential prize winner, such potential prize winner will forfeit his or her Prize and an alternate prize winner may be selected. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a Prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. The alternate potential prize winner will be selected by random drawing of the remaining eligible entries. The potential prize winner must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.

  • GENERAL PRIZE RESTRICTIONS/CONDITIONS: By entering, each Participant agrees on behalf of itself and each of Participant’s heirs, executors, and administrators (A) TO RELEASE AND HOLD HARMLESS CHALLENGE ENTITIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SHAREHOLDERS, INSURERS, PARENTS, SUBSIDIARIES, DIVISIONS, AFFILIATES, PREDECESSORS, SUCCESSORS, REPRESENTATIVES, ADVERTISING, PROMOTION, AND FULFILLMENT AGENCIES, AND LEGAL ADVISORS (collectively, “Released Parties“) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such Participant’s participation in the Challenge and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (B) that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, with respect to any Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose; and (C) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Challenge itself, and to be bound by all decisions of the Sponsor, which are binding and final. Failure to comply with these conditions may result in disqualification from the Challenge at Sponsor’s sole discretion.

All portions of the Prize(s) are non-assignable and non-transferable. Any Prize(s) pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Challenge materials are for illustrative purposes only. All details and other restrictions of the Prize(s) not specified in these Official Rules will be determined by Sponsor in its sole discretion.

  • PRIZES/ODDS OF WINNING:

Only the Prizes listed below will be awarded in this Challenge. Odds of winning depend on the number of eligible entries received during the Challenge Period.

PARTICIPANT CHALLENGE PRIZES:

Ten (10) First Prizes: Each Winner will receive a $50 Visa® Gift Card

Twenty-five (25) Second Prizes : Each winner will receive a $25 Amazon® Gift Card

Fifty (50) Third Prizes : Each Winner will receive a $10 Dunkin’ Donuts® Gift Card.

COA PRIZES:

One (1) First Prize : $1,000

Five (5) Second Prizes : $500

Ten (10) Third Prizes : $250

Limit: One (1) Prize per Participant and one (1) Prize per COA.

Sponsor reserves the right to substitute a Prize or portion thereof for one of equal or greater value if the designated prize or portion thereof should become unavailable for any reason

Should an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities, epidemics, pandemics and the spread of infectious diseases, including without limitation COVID-19 (as defined by the World Health Organization and any of the strains, variants or mutations thereof), and any related governmental or judicial actions, including but not limited to travel restrictions, taken in connection with, or as a response to, any such event, or any other event beyond the reasonable control of a party, whether or not existing, known, foreseen or foreseeable at the time this promotion occurs, render the redemption or fulfillment of some or all of the prize delayed, hindered, adversely affected, impracticable, or impossible, Sponsor in its sole and absolute discretion, reserves the right to evaluate and make modifications to the redemption and fulfilment processes and timelines for any Prize or portion of a Prize Sponsor is responsible for, which may include but is not limited to providing additional time for redemption and/or fulfillment. In addition, Participants should be aware of and comply with government guidelines regarding any restrictions and mandatory quarantines.

A potential winner who satisfies all of the Challenge requirements will be designated the official winner (the “Winner“).

Sponsor will not replace any lost, mutilated, or stolen prizes.

Winners are responsible for any and all applicable local, state, and/or federal taxes and fees arising from any prize award (if any).

DISQUALIFICATION: Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Challenge, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Challenge, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor reserves the right to modify, extend, suspend, or terminate the Challenge if it determines, in its sole discretion, that the Challenge is technically impaired or corrupted or that fraud or technical problems, failures, or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Challenge as contemplated herein. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding Prizes or continuing with the Challenge as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic/pandemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure“event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, extend, or terminate the Challenge. If the Challenge is terminated before the designated end date, Sponsor will (if possible) select the potential winner by random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each Participant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor.

  • LIABILITY WAIVER:

The Released Parties are not responsible for, and Participant hereby releases the Released Parties from any claims arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Challenge; (iv) electronic or human error which may occur in the administration of the Challenge or the processing of entries; (v) any injury or damage to persons or property, including but not limited to Participant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Challenge and (vi) use of any prize.

    • DISPUTE RESOLUTION/GOVERNING LAW:

      To the fullest extent permitted by law, by participating in the Challenge, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or this Challenge shall be filed exclusively in the federal or state courts of the Commonwealth of Massachusetts, and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action; (b) any such action shall be resolved individually, NOT as part of a class action; (c) any claims/judgments/awards shall be limited to actual out-of-pocket costs incurred in Participant’s entry into the Challenge (if any), but NOT attorneys’ fees, special damages, punitive damages, or consequential damages of any kind (including lost wages). These Official Rules and this Challenge shall be governed by the internal, substantive laws of the Commonwealth of Massachusetts, without regard to principles of choice of laws/conflict of laws of the Commonwealth of Massachusetts or of any other jurisdiction.

        • ARBITRATION PROVISION:

By participating in this Challenge, Participant agrees that any and all controversies, claims, counterclaims or other disputes Participant may have with, or claims Participant may have against the Challenge Entities relating to, arising out of or connected in any way with (a) the Challenge, (b) the awarding or redemption of any Prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate (a “Claim”), will be resolved exclusively by final and binding arbitration in accordance with the Rules of the American Arbitration Association (“AAA Rules“). The arbitration will be heard and determined by a single arbitrator. The arbitrator’s decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The parties agree that the arbitration proceedings will be kept confidential and that the existence of the proceeding and any element of it will not be disclosed beyond the arbitration proceedings, except as may lawfully be required in judicial proceedings relating to the arbitration, by applicable disclosure rules and regulations of securities regulatory authorities or other governmental agencies, or as specifically permitted by state law. The Federal Arbitration Act and federal arbitration law apply to this agreement. However, the Arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Official Rules including, but not limited to, a claim that all or any part of these Official Rules is void or voidable.
